EU to Impose Fines on Apple and Meta

The European Union is gearing up to levy fines on tech giants Apple and Meta, the parent company of Facebook, under its Digital Markets Act. The move comes as Brussels aims to address concerns about these companies’ market dominance without sparking a confrontation with the US.

According to sources familiar with the matter, Apple is expected to face fines and be required to revise its App Store rules. This follows an investigation into whether the tech giant’s policies restrict app developers from directing users to offers outside of its platform. Additionally, regulators will close another probe into Apple’s web browser choice screen design without imposing further penalties.

Meta, on the other hand, will also be fined and instructed to alter its “pay or consent” model. This model obliges users to either agree to data tracking or pay a subscription fee for an ad-free experience on its platforms.

While the Digital Markets Act allows for penalties of up to 10% of a company’s global turnover, the EU is reportedly aiming for fines below that threshold. This cautious approach reflects the newness of the EU’s digital regulations and the potential for legal challenges.

Enforcing the Digital Markets Act

Brussels’ efforts to enforce the Digital Markets Act highlight the EU’s commitment to regulating tech giants while minimizing transatlantic tensions. The focus is on ensuring compliance with the law rather than imposing exorbitant fines.

Notably, the EU is expected to drop a case concerning Apple’s operating system potentially discouraging users from switching browsers or search engines. This decision follows Apple’s efforts to align with EU regulations.

However, imposing fines on American tech companies carries risks, given President Donald Trump’s strong opposition to EU penalties on US firms. Trump has criticized such fines as a “form of taxation” and likened them to “overseas extortion.”

Navigating Transatlantic Relations

The EU’s handling of tech giant fines is seen as a pivotal test for the commission. Targeting US companies could escalate tensions and trigger retaliatory measures, ultimately impacting European businesses and member states.

President Trump has warned of potential tariffs on countries imposing digital services taxes on American corporations. In response, Meta has emphasized its compliance with EU regulations, stating that its changes exceed legal requirements.

The planned decisions on fines for Apple and Meta are expected to be presented to EU member states soon. While the timing of the announcement may change, the EU commission has refrained from commenting on the matter.
