New York Enacts Legislation to Safeguard Against AI-Driven Catastrophes

New legislation was passed in New York state on Thursday with the aim of preventing potential disaster scenarios caused by advanced AI models from major tech companies like OpenAI, Google, and Anthropic. The bill, known as the RAISE Act, sets out to avoid situations where over 100 people could be harmed or damages exceeding $1 billion could occur.

The approval of the RAISE Act signifies a victory for the AI safety movement, which has faced setbacks due to a focus on speed and innovation by Silicon Valley and the previous administration. Notable figures in AI safety advocacy, such as Geoffrey Hinton and Yoshua Bengio, have supported the bill, which, if enacted, would establish transparency standards for cutting-edge AI labs in the U.S.

Similar in some respects to California’s SB 1047, the RAISE Act was crafted by New York state Senator Andrew Gounardes to avoid stifling innovation among startups and academic researchers, a common criticism of the former. The bill is now awaiting Governor Kathy Hochul’s decision to sign it into law, request amendments, or veto it.

If enacted, the AI safety legislation in New York would mandate the largest AI labs to publish comprehensive safety and security reports on their advanced AI models. Furthermore, they would be obligated to report any safety incidents that may arise. Failure to adhere to these requirements could result in civil penalties of up to $30 million.

The RAISE Act is specifically targeted at regulating major companies, whether they are based in California or China, and whose AI models have utilized substantial computing resources. While sharing similarities with SB 1047, the RAISE Act addresses previous criticisms and does not mandate a “kill switch” or hold post-trained AI models accountable for significant harms.

Despite opposition from Silicon Valley, the bill’s co-sponsor Alex Bores assures that it will not impede technological innovation. However, concerns have been raised that developers may choose not to offer their advanced AI models in New York due to the regulatory burden, a scenario previously witnessed in Europe.

Assemblymember Bores remains confident that tech companies will continue to operate in New York, considering the state’s economic significance. The potential impact of the bill on smaller companies has been a point of contention, with some expressing worries about its broad scope.

Overall, the RAISE Act represents a significant step towards ensuring the safe and responsible development of AI technologies, balancing innovation with transparency and accountability.
