The Legal Implications of Meta’s Involvement in Elon Musk’s B Acquisition Attempt

Meta has been requested by OpenAI to provide evidence regarding any potential coordination with Elon Musk and xAI in relation to acquiring or investing in the ChatGPT-maker.

A recent development in Elon Musk’s legal battle against OpenAI has shed light on the request made by OpenAI for Meta to disclose any involvement in Musk’s proposed $97 billion acquisition of the startup earlier this year. The filing from OpenAI’s lawyers revealed that Meta was subpoenaed in June for documents related to this matter, but it remains uncertain if any relevant evidence exists.

OpenAI’s legal team claims to have uncovered communications between Musk and Meta’s CEO, Mark Zuckerberg, regarding xAI’s bid for the ChatGPT-maker, including discussions on potential financing options or investments.

Despite Meta’s objection to the initial subpoena in July, OpenAI is now seeking a court order to obtain the requested evidence. Additionally, OpenAI is also seeking Meta’s documents and communications related to any potential restructuring or recapitalization of OpenAI, a central issue in Musk’s lawsuit against the organization.

Against the backdrop of the legal dispute with Elon Musk, Meta has been actively investing in the development of advanced AI models, attracting talent from OpenAI, including key researchers like Shengjia Zhao. Meta’s investments in AI, such as the $14 billion in Scale AI, and its pursuit of acquisition deals with other AI labs, have further fueled the ongoing tensions.

Meta’s legal representatives have urged the court to dismiss OpenAI’s request for evidence, arguing that Musk and xAI should provide any relevant information. They also maintain that Meta’s internal discussions on OpenAI’s restructuring are not pertinent to the case.
