    Article:

The recent spotlight on Europe’s efforts to ensure fairness in the digital market has brought Broadcom to the forefront of potential antitrust scrutiny. Sanchit Vir Gogia, chief analyst at Greyhound Research, highlighted the growing regulatory interest in structural market behaviors, particularly in relation to licensing-related issues.

Following its acquisition of VMware, Broadcom made significant changes to how software is sold, sparking concerns about fairness and adherence to cloud computing principles. The company shifted from perpetual licenses and flexible pay-as-you-go models to mandatory three-year subscriptions with predetermined pricing, regardless of actual usage. This move has not only raised eyebrows but also sparked criticism for going against the fundamental operating principle of cloud computing.

In addition, Broadcom’s decision to discontinue individual product sales in favor of bundled packages, without adding new technical features, has left customers feeling compelled to pay for software they may not even need. The company’s billing structure, no longer based on actual usage, has been likened to an electricity provider suddenly charging customers as if their heating systems run at maximum power 24/7, with upfront payment obligations.

Industry experts, like Deepti Sekhri, practice director at Everest Group, have pointed out that while other enterprise software giants have pursued similar models, Broadcom’s approach stands out for its aggressiveness. Companies like Oracle and Microsoft have implemented similar changes more gradually or through ecosystem incentives, highlighting Broadcom’s unique stance in the industry.

Overall, the concerns raised about Broadcom’s licensing overhaul have sparked discussions about fairness, transparency, and adherence to cloud computing principles. As regulatory scrutiny continues to intensify, it remains to be seen how the company will address these issues and navigate the evolving landscape of the digital market.
